TERMS OF SERVICE

1. AGREEMENT TO TERMS

By accessing or using services provided by KINNEY'S RIDESHARE SERVICE LLC ("Company," "we," "us," or "our"), including vehicle rentals, reservations, or website use, you agree to be bound by these Terms of Service ("Terms").

If you do not agree, do not use our services.

2. ELIGIBILITY REQUIREMENTS

To rent a vehicle, you must:

• Be at least 21 years of age (or higher if required by insurance)
• Possess a valid, government-issued driver's license
• Have a clean driving record acceptable to our insurance provider
• Provide accurate and complete personal information

We reserve the right to deny service at our sole discretion.

3. RENTAL TERMS

Rental Periods

• Weekly Rental (~7 days)
• Bi-Monthly Rental (~60 days)
• 3-Month Rental (~90 days)

All rentals must be returned by the agreed return date/time unless extended.

Extensions

Rental extensions are not guaranteed and must be approved in advance.

4. PAYMENT TERMS

• All rental fees must be paid in full or as agreed prior to vehicle release
• Security deposits may be required
• Late payments may result in:
  • Additional fees
  • Suspension of rental
  • Vehicle repossession where permitted by law

By completing this reservation, you authorize KINNEY'S RIDESHARE SERVICE LLC to charge your saved payment method for future rental payments, fees, or damages as outlined in our Terms.

5. VEHICLE USE RESTRICTIONS

You agree NOT to:

• Use the vehicle for illegal purposes
• Allow unauthorized drivers to operate the vehicle
• Use the vehicle under the influence of drugs or alcohol
• Use the vehicle for racing, towing (unless permitted), or off-road use
• Operate outside approved geographic areas (if specified)

6. RIDESHARE USE

Vehicles may be used for rideshare services (e.g., Uber, Lyft) only if:

• You meet platform requirements
• You maintain all necessary approvals
• You comply with all local, state, and company regulations

The Company is NOT affiliated with or responsible for any rideshare platform.

7. MILEAGE & FEES

• Mileage limits may apply
• Excess mileage will be charged per mile
• Fuel must be returned at agreed levels
• Cleaning fees may apply for excessive dirt or damage

8. INSURANCE & LIABILITY

Insurance Coverage

• Basic insurance coverage may be provided where applicable
• Renters are responsible for understanding coverage limits

Driver Responsibility

You are fully responsible for:

• Traffic violations
• Tolls
• Parking tickets
• Any damages not covered by insurance

Indemnification

You agree to indemnify and hold harmless KINNEY'S RIDESHARE SERVICE LLC from any claims, damages, losses, or liabilities arising from your use of the vehicle.

9. ACCIDENTS & DAMAGE

In the event of an accident:

• Notify us immediately
• File a police report where required
• Do not admit fault

You are responsible for all damages not covered by insurance.

10. VEHICLE RETURN

• Vehicle must be returned on time and in original condition
• Late returns may incur additional daily charges
• Failure to return may result in:
  • Legal action
  • Recovery fees

11. EARLY TERMINATION

We reserve the right to terminate a rental agreement if:

• Terms are violated
• Payment is not made
• Vehicle misuse is detected

No refunds are guaranteed upon termination.

12. CANCELLATION POLICY

• Cancellation terms may vary by booking
• Fees may apply for last-minute cancellations

13. LIMITATION OF LIABILITY

To the maximum extent permitted by California law:

KINNEY'S RIDESHARE SERVICE LLC shall not be liable for:

• Indirect or consequential damages
• Loss of income (including rideshare earnings)
• Personal property left in vehicles

14. CALIFORNIA COMPLIANCE

This agreement is governed by the laws of the State of California.

Consumers may have additional rights under California law, including but not limited to:

• California Civil Code provisions related to rental agreements
• Consumer protection laws

15. DISPUTE RESOLUTION

Any disputes shall be resolved through:

• Good faith negotiation first
• Then binding arbitration in the State of California, unless otherwise required by law

16. PRIVACY

Your use of our services is also governed by our Privacy Policy.

17. MODIFICATIONS

We reserve the right to update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
